If you believe a person has committed a crime against you, the accused will not necessarily be immediately arrested and charged. Unlike what you may have see on TV, the decision to “press charges” doesn’t rest with the victim; it rests with the prosecutor.
THE MYTH OF THE FIFTH - We have all heard “I plead the Fifth” on TV, but what does it really mean?
Most people, have a vague idea of what this means. On TV this scene typically happens in a courtroom and it’s said by the person on trial who is refusing to say anything else.
The absolute most important thing to remember if you are arrested is that you have the right to remain silent and the right to an attorney. These rights, however, only protect you if you use them! If you are arrested, the single best thing that you can do for yourself is to keep quiet until you are represented by a lawyer.
